The City of Vaughan's Insurance & Risk Management section of the Clerk’s Department is responsible for three main areas: risk financing, risk control and claims administration. Risk Management works closely with all departments to minimize hazards and to promote community safety.

How to file a Claim
 

If you want to make a claim against the City, you must submit your claim in writing. It is recommended that claims be filed within ten days of occurrence.

Please note that the Municipal Act, 2001 S.O. 2001, Section 44 (10) requires that,

No action shall be brought for the recovery of damages under subsection (2) unless, within 10 days after the occurrence of the injury, written notice of the claim and of the injury complained of has been served upon or sent by registered mail to,

(a) the clerk of the municipality;

Your Claim Notice

To submit your claim you can complete the Claim Form, or you can prepare a written claim notice. Please note that your notice should include the following:

Contact Information

  • Name of claimant
  • Mailing address
  • Phone number
  • Email address

Include the above information of the person submitting the claim if different from the claimant.

Date and Location

  • Date of the occurrence
  • Time of day
  • Location i.e. intersection, directional and address references

(To determine the exact location please reference map.)

Description of occurrence

  • Briefly describe the actions leading up to your loss or injury

Type of damage or injury

  • Provide details of your damages or injury

Name of other parties involved

  • Should there be other parties involved in this occurrence other than the City please advise. i.e. Contractor

Supporting Documentation

  • Estimates, invoices, assessments

Photographs

  • Provide photographs of your damages

Next Steps

  • Within two weeks of the City receiving the claim, you should receive an acknowledgement from the Risk Management Department confirming receipt of your claim. This acknowledgement will have a claim number. Please retain this claim number as reference for future communication.
  • The Risk Management Department will commence an investigation based on the information you have provided.
  • Due to the uniqueness of each claim, we are unable to state when final decisions will be made on claims.

Claims involving York Region or Ministry of Transportation
 

For claims involving regional roads and infrastructure, please contact York Region at (905) 895-1231.

For claims involving the provincial highways and infrastructure please contact the Ministry of Transportation, at (416) 314-3440.

To determine whether a road is municipal, regional, or provincial please reference map.

Important: Fraudulent claims cost all taxpayers, for that reason all fraudulent claims will be prosecuted to the full extent of the law.
